Big Red is a recruitment business which provides work-finding services to its clients and work-seekers.

Big Red Recruitment ("Big Red") is a recruitment business providing work-finding services to clients and work-seekers. To deliver these services, Big Red must process personal data, including sensitive personal data, and acts as a data controller for all such information.

 

1. Collection and Use of Personal Data

a. Purpose of Processing and Legal Basis

Big Red collects and processes your personal data (which may include sensitive personal data) for the sole purpose of providing you with work-finding services and information relating to relevant roles. The legal pillars relied upon for processing your data are:

  • Contractual Obligation

 

b. Legitimate Interest

Big Red’s legitimate interests include:

  • Identifying and approaching suitable candidates for vacancies, including those who have indicated they are “Open to Work” on LinkedIn or have uploaded their CV to a job board.

  • Assessing your suitability for roles through interviews, screening calls, and communications.

  • Recording calls, conversations, and emails for the purposes of quality assurance, training, compliance, and to maintain an accurate record of communications during the recruitment process.

Recording of calls, conversations, and emails is essential to ensure transparency, maintain accurate records, and provide evidence of compliance with legal and regulatory obligations. These recordings are processed strictly in accordance with data protection laws and are only accessible to authorised personnel.
 

c. Recipients of Data

Your personal data may be shared with the following, only as necessary and with your knowledge:

  • Clients with whom we are seeking to place you in a role (after a screening call and with your permission)

  • Regulatory authorities, if required by law

Big Red does not share your data with third parties without your knowledge.
 

d. Statutory/Contractual Requirement

Providing your personal data is not a statutory or contractual requirement. However, failure to provide necessary information may prevent us from offering you work-finding services.


2. Data Retention

Big Red retains your personal data only as long as necessary, in line with legal and regulatory requirements:

  • Work-seeker records are retained for at least one year from the date of creation or the last date we provided you with work-finding services, as required by the Conduct of Employment Agencies and Employment Business Regulations 2003.

  • Payroll, holiday pay, and pension records are retained as required by HMRC and other applicable legislation.

  • Where processing is based on consent, we will seek renewed consent upon expiry of the retention period. If consent is not granted, we will cease processing your personal data.


3. Your Rights

You have the following data protection rights:

  • The right to be informed about the personal data Big Red processes about you

  • The right of access to your personal data

  • The right to rectification of your data

  • The right to erasure of your data in certain circumstances

  • The right to restrict processing

  • The right to data portability in certain circumstances

  • The right to object to processing based on legitimate interest

  • The right not to be subject to automated decision-making and profiling

  • The right to withdraw consent at any time
